Workers

If you are a non-United States of America citizen looking to immigrate to the United States of America and would
like a green card under the EB-3, Other Workers category, we would be pleased to work with you.

 

Step One: Permanent Labor Certification

We work with you and our employer partners located in the US on finding the right job for you. This includes interviews and proper legal filings with the US Department of Labor, among other critical steps.

 

 

Step Two: I-140 Alien Worker Petition

Once the PERM is approved through our work in Step One, we file the I-140 Alien Worker Petition before United States Citizenship and Immigration Services (“USCIS”) on behalf of the employer. Once the case is approved, you would become eligible to apply for a green card application. Please note that there are a certain number of visas allotted for this category each year. If you are from China, El Salvador, Guatemala, Honduras, India, Mexico, Philippines, or Vietnam, please contact us regarding current visa wait times for your country.

 

 

Step Three: I-485/ Consular Processing (Green Card Application)

Once your I-140 is approved in Step Two, the local US Consulate abroad will collect your information and documentation and schedule you for an interview for the immigrant visa. We will guide you through this entire process as your legal representative.

Welcoming you to the United States of America

Once you have been approved in Step Three, the local US Consulate will place a visa stamp in your passport. You must enter the US prior to the expiration of this visa. Upon entry, you will give a border officer the visa packet from the US Consulate. You then receive your green card and social security card in the mail. Again, we guide you through this entire process each step of the way.

Investor

For more than 20 years, Escrow Closing Solutions has been helping EB-5 investors receive green cards through their participation in job-creating American business ventures. Escrow Closing Solutions has a long track record of helping investors get approved at every step of the way – from the I-526 through the I-829 petitions, and even culminating in naturalizing as U.S. citizens. The EB-5 visa category was created to make permanent residency available to foreign investors who wish to invest in a U.S. business enterprise that will create jobs.

In 1992, Congress created an additional component of the standard EB-5 program, the Regional Center Pilot Program. A Regional Center is a private or public entity designated by USCIS that is authorized to coordinate with multiple immigrant investors and to pool their investments for greater economic impact. Regional Centers are authorized to operate within defined geographic regions that require approval by the USCIS through a rigorous application process. These Regional Center geographic scopes can be cities, counties, or entire states.

Escrow Closing Solutions

There are several differences between the standard EB-5 program and the Regional Center Program. The Regional Center Program allows the use of economic modeling to determine the direct, indirect and induced job impacts related to each investor’s capital contribution. This means that in the Regional Center Program, the EB-5 participant (investor) can count direct, indirect, and induced job creation as a result of their EB-5 investment. The Regional Center operator benefits investors by conducting all the upfront due diligence, underwriting, and managing of the EB-5 investment through all stages of the investment and immigration process.

There are several steps in the EB-5 immigration process for an investor to earn a green card. Once the investor selects a regional center and project, the investor would then work with their immigration attorney to file their I-526E petition requesting conditional residency. The USCIS then reviews and determines whether the investor and qualifying family members qualify for the conditional EB-5 visa(s). This part of the process includes a detailed review of the sources of the investor’s funds, family history, and other representations of the investor and family members included in the petition. This petition, (through association to the regional center’s I-956F petition) also includes a thorough description of the EB-5 investment project and any economic models used to determine job creation. If approved (an I-526E petition approval), the investor will schedule a consular interview to then receive a conditional green card that is valid for two years. Then the investor and family would declare residency in the United States.
